These Terms of Service ("Terms") govern your access to and use of the website sunpilot.ai, our solar analysis tools, email reports, physical mailers, and any other services provided by Sun Pilot, Inc. ("Sun Pilot," "we," "our," or "us"). Please read these Terms carefully before using our services.
By accessing our website, entering your property address, scanning a Sun Pilot QR code, submitting your contact information, or otherwise using our services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our services.
1. Eligibility and Authorized Users
To use Sun Pilot's services, you must:
- Be at least 18 years of age.
- Be a property owner of the address submitted for analysis, or be an authorized representative of the property owner with the legal authority to request information about that property and consent to contact related to it.
- Reside in or have a property interest in a state where Sun Pilot operates (currently California).
- Have the legal capacity to enter into binding agreements under applicable law.
By using our services, you represent and warrant that you meet all eligibility requirements. If you are submitting information on behalf of a property owner, you further represent that you have their express authorization to do so.
2. Nature of Our Services — Important Disclaimers
Estimates Only — Not Quotes. The solar analysis, energy production projections, cost estimates, savings calculations, and payback period estimates generated by Sun Pilot are AI-powered approximations based on publicly available data, satellite imagery, and regional solar resource information. They are not formal bids, engineering assessments, or guaranteed quotes from any solar installation company.
2.1 AI-Generated Estimates
Our solar analysis is produced using artificial intelligence models that process data including your property address, roof geometry derived from satellite imagery, regional solar irradiance data from the National Renewable Energy Laboratory (NREL) and Google's Solar API, and general utility rate assumptions. Actual results following a professional solar installation assessment may differ materially from our estimates due to:
- Roof condition, shading, or structural factors not visible in satellite data.
- Local permitting requirements, utility interconnection policies, or HOA restrictions.
- Changes in electricity rates, incentive programs, or equipment pricing.
- Site-specific conditions that require an in-person assessment by a licensed professional.
- Individual energy consumption patterns that differ from regional averages.
You should not make financial decisions based solely on a Sun Pilot estimate. We strongly encourage you to obtain one or more formal quotes from licensed solar contractors before committing to any solar installation.
2.2 No Installer Relationship Created
Sun Pilot is a lead generation and solar analysis platform. We are not a solar installation company, licensed contractor, or energy consultant. Using our services — including receiving a solar report, being connected with installers, or submitting your contact information — does not create any contractual relationship, warranty, or obligation between you and any solar installer.
Solar installers you may be connected with through Sun Pilot are independent third parties. Any agreement you enter into with a solar installer is solely between you and that installer. Sun Pilot has no responsibility for and makes no warranties about the quality, pricing, workmanship, licensing, or business practices of any installer.
2.3 No Endorsement of Installers
The fact that a solar company receives your information through Sun Pilot does not constitute our endorsement, certification, or recommendation of that company. You are responsible for conducting your own due diligence, including verifying contractor licenses, reading reviews, obtaining multiple bids, and reviewing contracts before signing any agreement.
3. Communications Consent
3.1 Email Communications
By submitting your email address to receive a solar report or to be connected with installers, you consent to receive emails from Sun Pilot including your solar analysis report, follow-up information about solar incentives and options, and communications from solar installers who receive your information. You may opt out of Sun Pilot emails at any time by clicking the unsubscribe link in any email we send.
3.2 Phone and SMS Communications
By providing your phone number and consenting to be contacted, you expressly consent to receive telephone calls and/or text messages (SMS) from Sun Pilot and from solar installers we connect you with, including calls and messages placed using automated technology or artificial intelligence voice systems. This consent is not a condition of receiving our free solar analysis. Message and data rates may apply. You may opt out of text messages at any time by replying STOP to any text message.
3.3 TCPA Acknowledgment
By providing your phone number and consenting to be contacted, you acknowledge that: (a) you are the subscriber or customary user of the phone number provided; (b) your consent covers autodialed and pre-recorded calls and texts; and (c) you are not required to provide consent as a condition of purchasing any goods or services. Sun Pilot and its installer partners comply with the Telephone Consumer Protection Act (TCPA) and applicable state telemarketing laws.
4. Acceptable Use
You agree not to use Sun Pilot's services to:
- Submit property addresses for properties you do not own or are not authorized to inquire about.
- Provide false, misleading, or fraudulent information.
- Scrape, harvest, or copy our solar estimates, reports, or content for commercial use without our written permission.
- Interfere with or disrupt our website, servers, or infrastructure.
- Use automated bots, scripts, or tools to interact with our platform without authorization.
- Attempt to reverse-engineer our solar estimation models or underlying technology.
- Violate any applicable federal, state, or local law or regulation.
We reserve the right to suspend or terminate access for any user who violates these restrictions.
5. Intellectual Property
All content on sunpilot.ai — including text, graphics, logos, solar analysis methodology, software, and the Sun Pilot brand — is owned by Sun Pilot, Inc. or its licensors and is protected by U.S. copyright, trademark, and other intellectual property laws.
Your solar report is generated for your personal, non-commercial use in evaluating your property's solar potential. You may not reproduce, distribute, or commercially exploit any Sun Pilot content without our prior written consent.
6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUN PILOT, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO: LOSSES ARISING FROM RELIANCE ON SOLAR ESTIMATES, DECISIONS TO PURCHASE OR NOT PURCHASE SOLAR SYSTEMS, INTERACTIONS WITH THIRD-PARTY SOLAR INSTALLERS, OR INABILITY TO ACCESS OUR SERVICES.
Sun Pilot's total aggregate liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the greater of (a) one hundred dollars ($100) or (b) the total amount, if any, paid by you to Sun Pilot in the twelve (12) months preceding the claim.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In those jurisdictions, Sun Pilot's liability is limited to the fullest extent permitted by applicable law.
7. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that: (a) our services will be uninterrupted, error-free, or secure; (b) solar estimates will be accurate, complete, or current; (c) any solar installer you are connected with will be licensed, qualified, or available; or (d) the use of solar energy will result in any specific savings or benefits for your property.
8. Dispute Resolution and Arbitration
8.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
8.2 Informal Resolution
Before initiating any formal dispute, you agree to contact us at legal@sunpilot.ai to describe your complaint and attempt to resolve it informally. Most concerns can be resolved quickly this way. We will respond within 30 days.
8.3 Binding Arbitration
If informal resolution fails, you and Sun Pilot agree that any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules, rather than in court. The arbitration will take place in Los Angeles County, California, or via videoconference. The arbitrator's decision shall be final and binding.
8.4 Class Action Waiver
YOU AND SUN PILOT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person's claims and may not preside over any class or representative proceeding.
8.5 Small Claims Exception
Either party may bring an individual claim in small claims court in lieu of arbitration, provided the claim qualifies under that court's rules.
8.6 Injunctive Relief
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction in Los Angeles County, California to prevent irreparable harm pending arbitration.
9. Privacy
Your use of our services is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection, use, and sharing of your information as described in the Privacy Policy.
10. Third-Party Services and Links
Our services integrate with or link to third-party services including Google Maps, NREL data portals, and installer websites. These third-party services have their own terms and privacy policies. Sun Pilot is not responsible for third-party content, services, or practices. Your interactions with third parties — including solar installers — are solely between you and those parties.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of our services after any modification constitutes your acceptance of the revised Terms. If you disagree with any changes, you must stop using our services.
12. Termination
We may suspend or terminate your access to our services at any time, with or without cause or notice, including if we believe you have violated these Terms. Sections 2, 5, 6, 7, 8, and all other provisions that by their nature should survive termination will survive any termination of these Terms.
13. Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Sun Pilot regarding your use of our services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties relating to such subject matter.
